General Terms and Conditions (GTC) of Hyrayse Outdoor Gym
1. Scope and provider
These General Terms and Conditions (GTC) apply to all contracts, uses, and business relationships that come about via the website www.hyrayse.de and on site at the Hyrayse training area.

2. Subject matter of the contract and services
Hyrayse offers outdoor fitness activities in the form of group courses, personal training, and open gym use on a specially equipped outdoor training area. Digital products, training information, and events are also offered.
3. Conclusion of contract and conditions of use
Use of the services requires prior registration via the website, booking via an online booking system, or registration on site. By registering, the user agrees to these terms and conditions. Minors may only use the services with the consent of their legal guardians.
4. Health status and personal responsibility
Participation in the courses and use of the training area is at your own risk. It is the responsibility of each participant to ensure that there are no health concerns that would prevent them from participating in sports activities.
The user undertakes to interrupt training immediately in the event of health complaints or pain and, if necessary, to seek medical attention.
5. Liability and disclaimer
Hyrayse shall only be liable for damages resulting from intentional or grossly negligent breach of duty. Hyrayse shall only be liable for slight negligence in the event of a breach of essential contractual obligations (cardinal obligations). In such cases, liability shall be limited to foreseeable damages typical for this type of contract.
Hyrayse accepts no liability for accidents, injuries, or other physical damage occurring during training, on the premises, or in connection with the use of the services. Each user acts at their own risk and is responsible for their own health and safety.
Valuables should not be left unattended. Hyrayse accepts no liability for loss or theft.
6. Data protection and contact for advertising purposes
Hyrayse collects, processes, and uses personal data only within the scope of the statutory provisions. By registering, the user agrees that Hyrayse may use personal data for the purposes of customer information, retention, and advertising.
This expressly includes contacting the user via WhatsApp, provided that the user has provided their phone number. The user may object to this use at any time with effect for the future.
7. Withdrawal, cancellation, revocation
Depending on the booking system, booked courses can be canceled up to a certain point in time before the start date. Refunds are generally excluded, unless otherwise expressly agreed. The statutory right of revocation remains unaffected by this.
8. Changes to the offer and the GTC
Hyrayse reserves the right to change the content or organization of the offer, to cancel courses, or to reschedule them. Likewise, these GTC may be changed at any time with effect for the future. The user will be informed of any significant changes in good time.
9. Place of jurisdiction and applicable law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Düsseldorf, insofar as this is legally permissible.
10. Severability clause
Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a provision shall be deemed to have been agreed that comes closest to the economic purpose.
